Medical Negligence

Eye Surgery Patient v. Surgeon

A 50 year old woman underwent laser eye surgery. Over a period of several weeks after the surgery, the surgeon directed the patient to use anesthetic eye drops which were toxic and caused a permanent injury to the patient’s eyes. A confidential settlement was reached shortly before trial.

Patient v. Nursing Home

A 91 year old nursing home patient fell in his room resulting in a fractured neck. His condition was worsened when nursing home staff moved him into a wheelchair before paramedics arrived. He died two days later. A confidential settlement was reached after depositions of key fact witnesses were taken.

Knee Replacement Patient v. Hospital

A 58 year old woman underwent a successful knee replacement surgery at a rural hospital. During an assisted transfer out of bed a day after surgery, the nurse failed to ensure the knee immobilizer was in place and dropped the patient resulting in a torn MCL on the operated knee. After the patient recovered from the initial surgery at a rehab facility, a revision surgery was required to repair the damage caused by the nurse’s negligence. Following the revision surgery, the patient developed an infection which spread requiring additional treatment including two more surgeries. A confidential settlement was reached after the pretrial conference.
