Toxic Torts

Minor Children v. Various Mining Companies

This case arose from the Tar Creek Superfund Site which is located in the far northeast corner of Oklahoma. I had the privilege of serving on a team of excellent lawyers representing over 150 children who had been lead poisoned by exposure to mining waste left from historic mining activities. This was a hard fought battle which lasted over six years. The litigation involved extensive fact and expert discovery in numerous states as well as lengthy, complex motion practice as each mining company was represented by multiple large law firms. Although the days and nights were long, seeking compensation for these children from the mining companies who polluted their towns remains one of the most rewarding experiences of my career. Ultimately, confidential settlements were reached with four mining companies. For a more detailed description of several aspects of the case, see B.H. et al. v. Gold Fields Mining Corp. et al., 506 F.Supp.2d 792 (N.D. Okla. 2007).
